These Terms of Service ("Terms") govern your access to and use of 4thand4cast.com and the related newsletter and stream ("4thand4cast," the "Service"). 4thand4cast is operated by Cathey Corp Media ("CCM"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service, and at least 18 to subscribe to a paid tier. If you are accessing on behalf of an organization, you represent you have the authority to bind that organization to these Terms.
2. Accounts
Some features (team-following, subscription management) require an account. You agree to provide accurate information and to keep your password secure. You are responsible for activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
3. Acceptable use
Don't:
- Use the Service to break any law or violate anyone's rights.
- Scrape, mirror, or systematically extract content beyond ordinary reading.
- Reverse-engineer or attempt to derive the underlying model (GIE) or its inputs.
- Use the Service to send spam, harassment, or commercial outreach to other users.
- Bypass any access controls or rate limits.
4. Editorial position and content
4thand4cast publishes original college football analysis, model outputs, and commentary. This site is about football, not gambling. Our framing is "by the numbers" — analytical, not prescriptive. We may reference betting markets in passing where they're contextually useful (e.g., comparing GIE's projection to the closing line as a calibration audit), but we are not a betting product: we do not publish picks, parlays, prop recommendations, or wagering advice, and nothing on the Service should be construed as such. Nothing on the Service is investment advice, betting advice, or a guarantee of any future outcome.
5. User-submitted content
If you submit feedback, comments, or other material to us, you grant CCM a non-exclusive, worldwide, royalty-free license to use that material in connection with operating and promoting the Service. You retain ownership of your submissions. Don't submit anything you don't have the right to share.
6. Subscriptions and payments
Free-tier access is, well, free. Paid-tier subscriptions are billed in advance through our payment processor on a monthly or annual basis at the price displayed at checkout. You can cancel any time; cancellation takes effect at the end of the current billing period. Refunds are at our discretion outside of legal requirements.
7. Intellectual property
Site design, written content, model outputs, GIE, the 4thand4cast brand, and the Pylon brand are the property of CCM or its licensors. You may share article links and quote short excerpts with attribution to 4thand4cast. You may not republish full articles, distribute model outputs commercially, or use our marks in a way that suggests endorsement without written permission.
8. Third-party content
The Service may link to or display content from third parties (news articles, ticket marketplaces, social posts). CCM is not responsible for third-party content and does not endorse it unless explicitly stated.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. CCM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY MODEL OUTPUT IS ACCURATE OR COMPLETE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID CCM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100.
11. Indemnification
You agree to indemnify and hold CCM harmless from any claim arising out of your breach of these Terms, your misuse of the Service, or your violation of applicable law or third-party rights.
12. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the Service or delete your account at any time. Sections 5, 7-12 survive termination.
13. Governing law
These Terms are governed by the laws of the United States and the state in which Cathey Corp Media is registered, without regard to conflict-of-laws rules. Disputes will be resolved in the state and federal courts located in that jurisdiction. (NOTE FOR COLE: confirm CCM's state of registration and update this section before public launch.)
14. Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be announced in the newsletter and reflected by an updated "Effective" date at the top of this page. Continued use after changes constitutes acceptance.
